Our partner Donovan was quoted in “Privacy This Week” by Data Guidance, where he shared his views on the Personal Data Protection (Compounding of Offences) Regulations 2016:
“The option to compound offences would most likely be welcomed by businesses, since it is an alternative to prosecution,” Donovan Cheah, Partner at Donovan & Ho, noted. “However, the penalties for the offences remain and a person who commits an offence under the Act is still subject to those penalties, in the event the prosecution is pursued. The Regulations merely provide an alternative to the PDP to make a compound offer and there is no guarantee that the PDP will make such an offer in any case.”
